This is a sensitive discourse and as such will be treated with high sense of responsibility. Firstly, in view of the nature of this platform, this discourse will be limited to basic knowledge. Secondly, Adoption procedure differs from State to State, accordingly the general requirements of law will be considered.
The understated sub-heads will be our guide:

1. What is Adoption?

It is a process whereby a person (a single parent or married couple) assumes the parenting of a minor from that minor’s biological or legal parents and therewith permanently assumes all rights and responsibilities, from the biological parents of the minor.

2. Who can be Adopted?

A person below the age of 18 years old;
a. Whose parent or surviving guardian consent to it; or
b. Who has been abandoned, neglected and/or ill treated

3. Who can Adopt?

There are 3 (three) categories of persons who can adopt:
a. Married Couple i.e. (Husband AND Wife)
b. A Married person (Either Husband OR Wife)
c. A single person (must be 35 years and/or above)

4. What Law Governs Adoption in Nigeria?

Principally, the Child’s Right Act.

5. Legal Effect of Adoption?

There are 2 (two) perspectives; for the Adopted child and the Adopting Parent:
The Adopted child has and enjoy all rights that would naturally accrue to the biological child of the Adopting Parent. The Adopted child also has equal rights (with biological children) to the Estate of the Adopting Parent.
All the rights, responsibilities and duties of the biological parents are extinguished and conferred on the Adopting Parents

6. Procedure of Adoption in Nigeria

Strictly speaking in law, an Application is to be made to the Court accompanied with relevant documents.
In practice, the Application is directed to the Child’s Welfare Center, designated Ministry etc., depending on the State of the Federation, the Child’s Welfare Center or such designated Ministry after carrying out necessary due diligence will then refer such an Application to the Court for consideration.

7. What are the documents needed for Adoption exercise?

a. Where the Applicant is married: Marriage Certificate or Sworn Declaration of Marriage
b. Where the Applicant is not married: Evidence that he/she has attained the age of 35 years
c. Birth Certificate or Sworn Declaration of Age
d. 2 Passport Photographs
e. Medical Certificate of fitness from a Government Hospital
f. Evidence that the Applicant(s) are/is citizens of Nigeria
g. Evidence of means by which the Applicant will maintain the Child

8. Can the Court Revoke an Adoption Order?

Yes.

9. What is the Place of Adoption under Native Law and Custom?

Adoption is not unknown to Native Law and Custom
